The nature of Ukuqala as a clinical tool and limitations of the Platform

Effective 1 May 2026Version 1.0

Ukuqala does not practise medicine. All clinical decisions are the exclusive responsibility of the licensed physician using this Platform.

1

Nature of the Platform

Ukuqala is a clinical decision-support and practice management platform designed exclusively for use by licensed, verified healthcare professionals. It provides digital tools to assist qualified physicians in their clinical workflows.

Ukuqala is NOT

a hospital, clinic, or medical practice

Ukuqala does NOT

employ physicians or practise medicine

Ukuqala does NOT

provide medical advice, diagnosis, or treatment

2

No Medical Advice from the Platform

Nothing on the Platform constitutes:

  • A medical diagnosis or differential diagnosis
  • A recommendation or prescription for treatment
  • Professional medical advice
  • A second opinion on a clinical matter
  • Emergency medical guidance

Any content generated by the Platform — including AI-powered symptom analysis, risk scores, ICD-10 suggestions, and clinical protocol references — is provided solely as a support tool for licensed physicians and must be independently reviewed and applied through the professional judgment of a qualified medical practitioner.

3

Physician Sole Responsibility

All clinical decisions made through the Platform — including:

  • Diagnoses and differential diagnoses
  • Treatment plans and therapeutic protocols
  • Drug prescriptions, dosages, and routes of administration
  • Referrals and specialist recommendations
  • Medical certificates and fitness-to-practise determinations
  • Interpretation of AI-generated suggestions
  • Decisions based on vital signs, symptom input, or uploaded records

— are the exclusive professional and legal responsibility of the licensed physician conducting the consultation. Ukuqala Health Technologies bears no responsibility whatsoever for any clinical outcome resulting from use of this Platform.

4

Limitations of Telemedicine

No Physical Examination

Video consultations cannot replicate diagnostic information from physical examination — auscultation, palpation, percussion, or observation of physical signs.

Equipment Dependency

Diagnosis may be limited by internet connection quality, camera resolution, and availability of diagnostic equipment at the patient's location.

Diagnostic Uncertainty

Certain conditions cannot be adequately assessed without in-person evaluation, laboratory tests, or diagnostic imaging not available remotely.

Emergency Limitations

Telemedicine is not appropriate for medical emergencies. A physician identifying or suspecting an emergency must immediately direct the patient to emergency services or the nearest hospital.

Prescription Limitations

Some medications and controlled substances require in-person evaluation before prescription in accordance with applicable law.

5

Emergency Services — Do Not Use This Platform in an Emergency

AI-Generated Clinical Content

AI-powered features in this Platform (Mistral AI) are experimental support tools with specific limitations:

  • AI models may produce incorrect, biased, or outdated outputs
  • AI models are trained on datasets that may not reflect the full diversity of African disease presentations, genetic profiles, or local disease burden
  • AI suggestions are not validated clinical diagnostic tools
  • AI models cannot examine the patient, assess non-verbal cues, or apply contextual judgment

Every AI-generated output must be reviewed and validated by the licensed physician before any clinical use. No AI suggestion should be communicated to a patient as a diagnosis or treatment recommendation without the physician's independent assessment.

7

Limitation of Liability

To the maximum extent permitted by applicable law, Ukuqala Health Technologies shall not be liable for any loss, harm, injury, death, or damage of any kind arising from reliance on the Platform, AI-generated suggestions, clinical content, or any physician's use of the Platform in treating a patient.

The Platform is provided “as is” and “as available”, without any warranty of fitness for a particular clinical purpose or clinical accuracy. Nothing in this Disclaimer limits liability for death or personal injury caused by Ukuqala's own gross negligence or fraud.

This Medical Disclaimer forms part of the Ukuqala Terms of Service. It must be read alongside the Privacy Policy, Telemedicine Consent, and AI Disclosure. Effective 1 May 2026 · Version 1.0
